JAKARTA - Minister of Energy and Mineral Resources (ESDM), Ignasius Jonan not afraid of threat from PT Freeport Indonesia which will drag the government to international arbitration.

This is related to
Government Regulation (PP) No.1/2017 which requires changing the status of the Freeport contract of work (COW) into a special mining license (IUPK), to obtain an export permit concentrates.

A clause in the contract of work (COW) held by the government and Freeport, said Jonan, the right to sue to international arbitration is not just businesses of COW holders. However, the government also has the same right to drag the COW holders to arbitration.

"Not only Freeport who can bring to arbitration, the government also can do," Jonan said in the House of Representatives building, Jakarta, Monday (20/2).

Nevertheless, Jonan still hope in the near future will reach the intersection with Freeport to these problems. If not, this former Minister of Transportation is also ready to serve Freeport in international arbitration.

"Hopefully reached common ground. If for example, until not reached common ground, yes indeed it's the right of each to bring to arbitration," he said.

As reported earlier, Freeport Indonesia threatened to drag the government to international arbitration, related to the regulation. The arbitration will be filed if within 120 days into the future there is no common ground on the issue.

President and CEO of Freeport-McMoran Inc. Richard C Adkerson said Freeport is currently still negotiating with the government. Giant mine from the United States (US) have confirmed that they will not relinquish COW in order to get an export permit concentrates.

"So we are now still negotiating with the government, where the government will rescue our families. Outstanding Freeport can not break our contract, so now we wait," he told a press conference in Jakarta, today.
