Not Focusing on Substance, Aqua Witness Judged Oddly

JAKARTA - Investigator of Business Competition Supervisory Commission (KPPU), Arnold Sihombing said that Sudali, witness presented by Aqua gave a far testimony to the substance of the problems.
According to him, testimony of Sudali as the owner of Tirta Willys Shop did not explain the details about the invitation from Yatim Prasetyo, store owner whose status was derived from SO to WAS by Aqua. Whereas initially, Sudali admitted to Yatim Agus not to sell Aqua products.
This was revealed by Arnold in the continued court of the alleged monopoly of bottled drinking water (AMDK) between PT Tirta Investama and PT Balina Agung Perkasa at the Office (KPPU), Jakarta, Wednesday (4/10).
Arnold admitted awkwardly with Sudali's statement. According to him, Sudali also did not know about the reason Yatim Agus to Aqua. He suspects this Sudali testimony has been made by the Balina.
"So Sudali was approached by Balina to make a statement that Agus had been invited not to sell Aqua.Sudali was just a signature of the statement, not conceptual. Sudali never contacted the Balina, but suddenly the Balina came and offered a statement," Arnold said in a written statement on Friday (6/10).
Arnold then outlines his alleged chronology. Sudali, he said, was visited by Nursamsu from PT Balina who is an affiliate of Aqua, then Nursamsu drafted the statement. After that Sudali just signed.
According to Arnold, Sudali's testimony which explains that the call to not sell Aqua products in the trial does not alleviate or eliminate the behavior of PT Balina which prohibits Yatim Agus from selling Le Minerale.
"Sudali's testimony can not explain the behavior of Le Minerale's sale ban," he explained.
Arnold explained that Sudali's comments and the second witness presented only explained the continuing impact of sanctions received by Agus's Cucun Shop.
The second witness, he continued, did not even understand about the issue of Balina Agung Perkasa/Tirta Investama's behavior threatening to reduce store status from SO to WS.
"It means there is no evidentiary value that could ease the demands or refute the fact of the ban and sanction of SO store degradation because it sells competitor products," said Arnold.
In the last trial, based on testimony Sulistiyo Pramono called one of the managers of PT Tirta Investama. Based on an email owned by the Investigator Team of KPPU, it was revealed that there was an email correspondence from Sulistiyo Pramono to the supervisor at PT Tirta Investama who showed Sulistiyo Pramono not working alone. There are parties who are more responsible for the decline of Vanny aka Cuncun's store's status.
