JAKARTA - Ministry of Religious Affairs (Kemenag) decision which revoked operational license of umrah travel services PT First Anugerah Karya Wisata (First Travel) plans will to sued.
First Travel's lawyer, Eggy Sudjana, confirmed if First Travel will sue Kemenag to the State Administrative Court (PTUN).
"We will sue the Ministry of Religious Affairs," Eggy said after a discussion of Polemic SINDO Trijaya Network titled 'Dream and Reality First Travel' at Jakarta, Saturday (12/8).
It considers the revocation of the permit has harmed others. He refers to Article 1365 of the Civil Code which states whoever is against the law and incurs other people's losses must compensate the person.
"It could be charged to the Administrative Court," he said.
Eggy also plans to penalize the Ministry of Religious Affairs which is considered to violate Article 421 of the Criminal Code (KUHP) for allowing illegal levies of visa making.
"Because of the illegal charges, we will not be responsible in the context of my clients to comply with the loss. How to be responsible, his license has been revoked, he (First Travel Director) was arrested," he said.
In this case, the Directorate General Crime of Police Criminal Investigation has appointed First Travel President boss, Andika Surachman and Anniesa Hasibuan as suspects of fraud. In the same place, the Ministry of Religious Affairs (Kemenag) confirmed that the loss of candidates for umrah pilgrims is the responsibility of First Travel, even if the company's license has been revoked.
Head of Data and Information Center of Ministry of Religious Affairs, Matsuki said First Travel is still obliged to refund or refund candidate of umrah pilgrims who failed to go to Saudi Arabia. In addition, First Travel is also required to dispatch prospective umrah pilgrims through other bureaus.
