Immediate Revision of Migrant Workers Protection Law

JAKARTA - In order to create an integrated service model, President Joko Widodo (Jokowi) has called for an immediate revision of law on migrant workers protection.

"The president stated that it (the revision) should be completed soon, so that an integrated service model could be created in the future," chief of National Agency for Placement and Protection of Migrant Workers (BNP2TKI), Nusron Wahid noted after meeting with president on Monday (20/3).

Currently, Indonesian workers in the naval base, including ship crews, are not recorded by the BNP2TKI.

"The law is implemented by the Transportation Ministry; thus, they are not recorded as migrant workers," Nusron said, adding that the revised law would improve workers protection.

"The revised law would strengthen workers protection and simplify the process under an integrated service agency," he revealed.

Under the revised law, BNP2TKI would have greater authority in the one-roof integrated services.

"Currently, some of the authority has been taken by the Manpower Ministry and some by the Transportation Ministry. Under the revised law, the ministry would serve as a regulator, and the agency would serve as an operator that would be accountable to the president," he remarked.

Nusron stated that the revision of the law is expected to be finalized this year.

Meanwhile, related to deposit requirement for the applicant to Rp25 million for new passports, Directorate-General (DG) of Immigration Ministry of Justice and Human Rights (Kemenkumham) finally decided to cancel it.

Head of Public Relations General Directorate of Immigration, Agung Sampurno said, it is because many people's negative sentiment about the policy.

"People seemed less than pleased with this policy. In the language of intelligence media namely, negative sentiment. Therefore for us (DGI) if not pleased, the community must be heard if the policy is not understood," said Agung in his office, Jakarta, Monday (20/3).

In fact, Court said, the point is not merely a sentence Rp25 million. However, he said, should be seen to be an official document or not.

Recently, Director General (DG) of the Immigration Ministry of Justice and Human Rights (Kemenkumham) Ronny F Sompie asserted, Rp25 million deposit requirements are specific requirements for the citizen who is suspected to be a migrant worker abroad and not registered in BNP2TKI.

"Yes, that requirement only applies exclusively to the citizen who is suspected to be a migrant worker. But it is not listed in BNP2TKI," Ronny said in Jakarta, Sunday (19/3).

Ronny added, the regulation has been intensified at the beginning of 2017 yesterday with a specific purpose, namely, to minimize the occurrence Crime of Trafficking in Persons (TPPO) in the destination country of the citizen.
